GENERAL

Listed below are the Class Act Agency and www.classactagency.co.uk Terms and Conditions. By accessing the services of Class Act Agency or the Class Act Agency Website, you agree to be bound by these Terms and Conditions.

"Agency" refers to Class Act Agency.

"Website" refers to the Class Act Agency Website, www.classactagency.co.uk

"Author" refers to all authors, poets, storytellers, illustrators and other artistes held on the Class Act Agency database.

"School" refers to a school, library or other public venue.

Class Act Agency provides this site and its contents on an "as is" basis and makes no representations or guarantees of any kind with respect to this site or its contents. In addition, the Agency does not represent or guarantee that the information accessible via this site is accurate, complete or current.

If any part of these Terms and Conditions are deemed to be unlawful, void or for any reason unenforceable, then that part shall be deemed to be severable from these Terms and Conditions and shall not affect the validity and enforceability of any of the remaining Terms and Conditions.

BOOKINGS

Class Act Agency is a booking agency. These are the Terms on which the Agency will make a booking for your School.

The Agency keeps a database of Authors who make School visits. The Agency advertises and promotes Authors and arranges visits into Schools.

The Agency uses the information given by the School to match an appropriate Author to the needs of the School.

The booking information that the School provides will be passed on only to those persons relevant to the arrangement of the booking. In making this booking, you consent to this information being passed on to the relevant persons.

When making a booking the Agency will arrange for the School to enter into a contract with the Author.

When a booking is made and the School and Author are satisfied with all arrangements, the details will be read back to you. Once you have confirmed these details we will proceed to confirm the booking in writing. Please check that all names, dates and timings are correct on receipt of all documents and advise us of any errors immediately.

The Agency adds an administration charge of £40 (or 10% of the Author's fee, if over £400) to all bookings to cover all advertising, handling and booking fees. This fee is included in the full day or half day prices as listed on the Website so for full or half days no extra administration charge will be made.

For all other arrangements, e.g. Residencies and Inset work, further fees may be added. All charges are made known at the time of booking. All charges are exclusive of VAT.

Authors are responsible for setting their own rates and the Agency takes no responsibility for the rates charged by the Authors. Authors' rates may change as and when the Author chooses and these adjustments will be shown on the Website as and when they are made known to Class Act Agency.

Schools will receive an invoice following an Author visit. All accounts must be paid in full within 21 days of the invoice date.

If for any reason there is an alteration or cancellation by the Author, the Agency will notify the School as soon as possible. If there is sufficient notice, an alternative Author will be offered. If no acceptable alternative can be found, the Agency will cancel the booking. The Agency cannot accept responsibility for failure to secure alternative bookings or for cancellations.

Alterations or cancellations by Authors must be notified to the Agency. Acknowledgement of the alteration or cancellation will be sent by the Agency to the Author and the School.

The Agency does not accept liability for any personal injury or death during the operation of a booking for either party. The Agency will not be liable in contract or otherwise for any economic losses or any loss of goodwill or reputation during the Author visit.

AUTHOR VISITS

The Agency is not an employer of Authors.

The Agency strongly recommends that Authors obtain a Criminal Records Bureau Enhanced Disclosure Certificate to comply with security measures and government guidelines increasingly being enforced by educational establishments. It is the responsibility of the School to confirm with the Author that this security check has been obtained before the booking is confirmed in writing.

The Agency accepts no responsibility for the acts of the Author or for the services provided by the Author. The Agency actively gathers feedback from Schools following an Author visit. Any Author receiving regular negative feedback is removed from the Agency database.

All Schools are responsible for arranging Public Liability Insurance to cover any incident during an Author visit. However, the Agency strongly recommends to the Authors on its database that they arrange for Public Liability Insurance to be in place at an appropriate cover amount prior to a school visit. The Author is responsible for obtaining Public Liability Insurance. The Agency will not accept responsibility if a School does not make necessary checks before a booking is confirmed.

The Author agrees not to enter into any negotiations or to accept re-bookings offered as a direct result of a booking made through the Agency without reference to the Agency - all follow-up bookings will be negotiated through the Agency in its capacity as booking agent.

All information on the Author Pages has been supplied by the Authors themselves and the Agency does not vouch for its accuracy. It is the School's responsibility to ask relevant questions and make any necessary checks before confirming any booking. The Agency has made every effort to ensure that the information provided is accurate.

THE WEBSITE

The Website makes every effort to check and test material on the Website at all stages of production. It is always wise for users to run an anti-virus program on all material downloaded from the Internet. The Agency cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur as a result of uploading to or downloading from the Website.

Class Act Agency reserves the right to:

(a) select an Author to feature on the Website and to exclude or include any Author from featuring on the Website. Any Author can refuse the offer to be included on the Website. An Author's inclusion or exclusion on the Website by the Agency is in no way an endorsement or otherwise of the Author;

(b) include or exclude any information on the Website. The Agency will make all reasonable endeavours to correct any errors on the Website but does not guarantee that any errors on the Website will be corrected;

(c) modify or withdraw, temporarily or permanently, the Website (or any part of it) with or without notice to its users. The Agency and the Website will not be liable to any user or any third party for any modification to or withdrawal of the Website;

(e) monitor any activity and content associated with the Website. The Agency reserves the right to investigate any reported violation of these Terms and Conditions or complaints relating to the Website and to take any action that is deemed appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to an individual's or group's access to the Website and/or removing any materials from the Website).

The Agency will take all reasonable steps to ensure the Website is up to date and accurate. The Website is subject to change from time to time. Users will not be eligible for any compensation if any part of the Website is unavailable at any time or because of a failure, suspension or withdrawal of all or part of the Website for any reason.

Website users acknowledge that the Agency and the Website cannot guarantee and therefore shall not be in any way responsible for the security or privacy of the Website and any information provided to or taken from the Website by users.

This Website has links to other Internet websites. The Agency cannot guarantee that these links will function at all times and has no control over the availability of linked pages. Linked websites are controlled and maintained by third parties even though they may display the Class Act name or refer to the Agency in some way. These links are included solely for the convenience of Website users and do not constitute any endorsement by the Agency or the Website. The Agency has no control over the content of any such websites nor is responsible for the content or reliability of the linked websites. Please let the Agency know if you have concerns about any such site so removal of the link can be considered.

Website users agree that in the event that they have any right, claim or action against any third party arising out of that third party's use of this Website, then they will pursue such right, claim or action independently of and without recourse to the Website or the Agency.

Third parties may provide links to this Website from other websites. In the event that we inform the third party that any such link is unsuitable, inappropriate or unsatisfactory for any reason, the third party must remove any such link immediately.

Users will not use this Website (or any part of it) for any illegal purpose and agree to use it in accordance with all relevant laws; users will not upload or transmit through the Website any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or any material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety; users will not use the Website in a manner which may cause the Website to be interrupted, damaged, rendered less efficient or undertake any actions such as to impinge on the effectiveness or functionality of the Website or to in any way impair or violate or infringe upon the rights of any person.

INDEMNITY

Users agree to be fully responsible for (and fully indemnify the Agency and the Website against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by the Agency and/or the Website and arising out of any breach of the Conditions by the useror any other liabilities incurred by the Agency and/or the Website arising out of a user's or users' use of the Website, or use by any other person accessing the Website using an individual's or group's computer or internet access account.

CHANGES IN TERMS

Class Act Agency reserves the right to modify these Terms and Conditions at any time without prior notice. Any modification of these Terms and Conditions will be deemed to be effective from the date and time of posting on the Class Act Agency Website. It is users' responsibility to check regularly to determine whether the Terms and Conditions have been changed. Continued use of the Website following any such change or changes shall be deemed to be acceptance of such change or changes.
